In response to a petition alleging that the All India Tennis Association (AITA) will hold its election later this month in contravention of the Sports Code, the Delhi High Court requested the AITA’s position on Tuesday. In response to a petition by former Indian tennis players Somdev Devvarman and Purav Raja,
the sports body and the Center received notice from Justice Purushaindra Kumar Kaurav. The election will be contingent upon the resolution of the plea, the judge stated. The polls are planned to be held on September 28. The judge issued this directive in addition to refusing to delay the election at this time.
Senior legal counsel representing the petitioners contended that AITA was conducting the poll in a “clandestine manner” because “nothing was on the website”.
The senior attorney filed a request for a stay of the election, arguing that the AITA’s actions were blatantly against both the Sports Code and the rulings made by the high court.
The petitioner was requested by the court to include the Returning Officer of the election as a party in the proceedings, and the respondent parties were requested to submit their responses.
It also said that the elected office bearers would not be permitted to continue in their roles and that an independent body might be named in their stead if it turns out that the election violated the Code.
I’m leaving. A lot of planning goes into an election. If the election procedure is undertaken in violation of the subsisting orders, the office bearers will be barred from functioning.
Next, we’ll think about designating someone as the ad hoc (body)…The court declared, “That election will be set aside. In the interim, respondent no. 2’s election will be contingent upon the resolution of the current writ petition. The court ruled that the election results will not be made public.
